Hopes are still alive for JBT waiting List candidates as per this decision of High Court:By this order I propose to dispose of CWP No. 19232 of 2011and nine connected writ petitions i.e. CWP No. 17572 of 2011, 18958 of 2011, 19658 of 2011, 19677 of 2011, 20958 of 2011, 21251 of 2011, 582 of 2012, 6738 of 2012 and 10776 of 2012 as the prayer made by the petitioner (s) in these writ petitions is the same and is arising out of the same selection.Haryana Staff Selection Commission(for short 'Commission')advertised 9647 posts of J.B.T. Teachers, wherein separate seats were reserved for each category. After making selection the Commission made recommendation of 8401 candidates for appointment to the post of J.B.T. Teachers, which included 4257 of the general category and 4144 of the reserved category. There were total 603 candidates belonging to the generalas well as reserved category placed in the waiting lists by the Commission.Petitioners, who belong to differentcategories have approached this Court with a grievance that despite their names being recommended in the waiting list and the posts which were advertised in their category are still unfilled because of non-joining of the selected candidates, who were offered appointment or for any other reason they were not issued appointment letters, the respondents are not filling up the said posts despite the petitioner(s) being available from the waiting list.Upon notice issued by this Court, written statements have beenCWP No. 19232 of 2011 -4- filed by the respondents. In the reply filed by respondents No.1 & 2, the factum that recommendationsincluded the names of the waiting list candidates of which petitioners are also there and to some of themthe letterof offer of the appointment have also been issued is not disputed. Counsel for the respondent is, however, not in a position to make statement as to whether all the advertised posts of different categories, of which recommendationshave been made,have been filled up or not. Counsel for the petitioner on the basis of the information received under theRight to Information Act, 2005 states that 254 posts of J.B.T. Teachers, out of this very selection for which recommendationswere made are still unfilled.In the light of the above position, this Court is of the consideredopinion that the above mentioned writ petitions deserve to be disposed of with a direction to the respondents to fill up the posts, which were advertised and the recommendationsqua which posts have been made by the Commission from each category of waiting list candidates in case the post in that particular category havestill not been filled up, the offer of appointment be issued to the recommended candidates strictly according to their merit in the waiting list, in the category in whichthey were selected.This exercise be completed by the respondents within a period of two months from the date of receipt of certified copy of this order.(AUGUSTINE GEORGE MASIH)JUDGE
